In Florida, automobile owners are required to purchase personal injury protection (PIP) no fault insurance coverage. Insurance pays up to $10,000 for medical bills and lost wages from a car accident.  Even if the accident is the insured person’s fault, the coverage still applies.  This law, is sometimes referred to as the No Fault Statute. 

The Florida No Fault Statute does not provide coverage for pain, suffering or loss of enjoyment of life.  These are types of damage for which there must be fault, which is referred to as “liability.” 

The purpose of the PIP (Personal Injury Protection) law is to promote the ability of injured persons to get medical treatment without having to wait.  Sometimes, the injured may wait to first determine who caused the accident.  To determine fault can be a time consuming process. Therefore, a time delay could affect the ability of the injured to get prompt medical treatment.  This law predated the era of today when most people have health insurance. Some people have argued that Floridian’s no longer need PIP coverage.

However, PIP also covers lost wages as well as funeral expenses.  It provides coverage that most people even with health insurance don’t normally buy.  

Also, new changes in the PIP law require an injured person to seek treatment within 14 days of the accident.  If not, they may not be able to use their PIP coverage.  Especially if that person feels any neck, back, or pain to any other part of the body.  Waiting too long to see if it “goes away,” can result in lost insurance coverage.  Read our post about “Delay in Feeling Pain After an Accident.”  There are many factors that contribute to not feeling pain right away after a car crash.

In addition, a medical doctor needs to examine an injured person to provide a written opinion.  It must state that the insured sustained an emergency medical condition in order to use coverage in excess of $2500.  This is another important requirement in order to use all of the available PIP insurance benefits.  Because of these requirements, it makes understanding the law difficult.  It is important that you consult with an experienced attorney with knowledge of No Fault Insurance.
